FSSAI invites comments on registration facility for certain high risk products

The Food Safety and Standards Authority of India has invited stakeholders comments on restriction of registration facility for certain food products/categories which are high risk products including food for infant nutrition, milk powder & condensed milk, packaged drinking water and mineral water.  

Earlier, in October 2024, the FSSAI had omitted the regulations mandating BIS certification marks for these products.

According to FSSAI, while the step was taken to simplify the ‘regulatory landscape’ and affirm the role of the food regulator for ensuring compliance and product quality along with safety, a proposal has been formulated to restrict the eligibility of manufacturers of these high risk products for registration under the FSSAI framework.

“To further strengthen the compliance ecosystem a proposal has been formulated to restrict the eligibility of manufacturers of certain high risk products for registration and allowing only licensing (Centre or State),” reads a notice issued by the FSSAI while adding that the proposal also adds a pre-license inspection requirement of the manufacturers of these high risk category products.

Food Business Operators (FBOs) manufacturing the said products are currently eligible for obtaining either FSSAI Registration or FSSAI Licence (State/Central), based on their eligibility.

Registration involves fewer compliance obligations compared to Licensing, wherein there is no mandatory product analysis, no submission of annual return, no requirement of qualified technical personnel, no mandatory annual third party audits, and only need to comply with basic hygiene and sanitary standards.

Further, under the proposal a reasonable transition period [06 months] will be given to FBOs to shift to the Licensing category and utilise existing packaging and labelling materials, if any.

After the transition period, system-based modification in the FoSCoS portal [without any fee] to remove these products from their Registration Certificates [RC] will be carried out to debar them from further manufacturing under RC.
