Licensing: Advisory directs authorities to only look for relabeller KoB related info

The food authority has issued an advisory for streamlining the FSSAI licence application process for ‘relabellers’ and directed the licensing authorities to only look for ‘relabeller’ kind of business (KoB) related info in the application and not for the manufacturer related queries.
“The scrutiny of application for relabeller licence may be limited only related to relabeller i.e., without relating to the compliance by the linked manufacturers. The manufacturers shall anyways be checked for compliance by the concerned licensing authority as per the FSS Act and rules,” reads the advisory issued by the FSSAI.
The FSSAI has made another provision for licensing of relabellers that a disclaimer needs to be added to the online NOC issued by the manufacturers.
“Additionally, in order to eliminate any scope for ambiguity, online NOCs issued by manufacturers to relabellers will now include the following disclaimer – ‘This NOC does not authorise the manufacturer to manufacture the food products unless the mentioned product are endorsed in the manufactured licence’,” the advisory added.
Further, the FoSCoS (Food Safety Compliance System) now allows the licensing authorities to compare the modification application with the previously submitted application, enabling them to identify the changes made by the food business operators, which would help the authority to focus only on the changes made in the modification application.
According to the FSSAI, the food authority was in receipt of several representations from the food businesses expressing concern regarding the process of licensing of relabellers kind of business as licensing authorities were raising manufacturers related to queries to relabellers despite the latter having valid online NOC from the licensed manufacturers resulting into delays in processing of the licence applications.
An official with the FSSAI says, “While applying for relabeller licence and sending online NOC request to the desired manufacturer, FoSCoS ensures that manufacturer has already endorsed products of the same food product category and sub category in its licence, for which the relabeller was seeking NOC. In light of this the licensing authorities were asked not to ask manufacturer related queries under relabeller kind of business.”
