HFSS foods not fortified processed foods as no clear definition: FSSAI

The FSSAI has said that the recently notified regulation -- Food Safety and Standards (Fortification of Food) First Amendment 2020, governing fortified processed foods, shall apply for foods high on fats, salt and sugar, once the definition of these food products is decided under the FSS Act.

In this regard, the apex food regulator has issued a clarification on exclusion of the high fat, sugar & salt (HFSS) food from the ambit of the notified regulation.

According to the FSSAI, representations were made seeking clarification regarding the notified regulation and exclusion of the HFSS food products.

Under Sub-Regulation 7 of the fortified food products’ regulation, HFSS foods shall be excluded from the fortified processed foods category.

The FSSAI clarified that since there was no definition of the HFSS food, therefore such food products shall be excluded.

FSSAI's clarification reads, “Considering the fact that the HFSS Foods have not been defined and notified in the Food Safety and Standards (Labelling and Display) Regulations 2020, it is clarified that the compliance of Sub-Regulation 7 shall come into effect once the HFSS food are defined and notified under the FSS (Labelling and Display) Regulations 2020.”

Recently, FSSAI has notified rules for  fortified processed foods including cereal products,  bakery wares and fruit juices. The regulation explains that ‘Fortified Processed Foods’ may be prepared from fortified food articles that may be cereals and/or milk and shall provide 15-30% of the Indian adult RDA of micronutrient based on an average calorie intake of 600 kcal from processed foods (approximately 1/3rd of daily energy requirement for an adult).
