FSSAI issues advisory for speedy clearance of imported consignments

The FSSAI has issued an advisory for speedy clearance of the imported consignments intended for captive use or production of value-added products meant for 100% export/re-export purpose. The food authority has asked the Customs authority not to refer such consignments for clearance to FSSAI.

The advisory says that unless otherwise specified, the Customs authority need not refer the imported articles of food to the food authority for clearance if such articles of food are meant for the re-export purpose.

“Food imported by the manufacturers of processors for their captive use or production of value-added production for 100% export/re-export may avail provision (under FSS Act) by making a declaration to the Customs in prescribed Form - 8 specified under the Food Import Regulations 2017 at the time of filing Bill of Entry in Icegate,” said Manvesh Kumar, Director, Trade and International Cooperation, FSSAI.

He added that in case of any bill of entry which is filed by importer availing the referred provision and the bill is still transmitted by the Icegate to FSSAI’s Food Import Clearance System  (FICS), the concerned FSSAI official may issue a ‘Not in Scope’ Certificate after verification of the document with due diligence and without usual requirement of visual inspection, sampling and testing.

The food authority explained that the importers under the law require to declare in Form - 8 regarding the captive or end use of the imported product to the Customs department at the time of filing the bill of entry, declaring that the imported articles of food are meant to be used by the importer for 100 per cent export or reimport of article for export again as the case may be and that no part thereof shall be supplied for domestic consumption.

However, such exemption was not applicable in the case of trading entities, which do not import such items for their captive use due to problems associated with traceability of the end use of such items.
