FBOs can now change their address sans change in licence number

The food regulator of India, FSSAI, has decided to allow food business operators to change the address of the premises without changing the FSSAI licence or registration number.
The FSSAI has issued an order in this regard, saying that to facilitate food businesses in retaining the existing licence or registration number, even if they change the location of food unit, it has been decided to enable the relevant provision for changing the State/UT or District in FoSCoS while applying for modification of FSSAI licence/registration.
According to the FSSAI, at present, food businesses face problems in retaining their existing licence or registration number in case they change the premises of their food units. FBOs were required to surrender their existing licence and apply for new licence.
An official with the FSSAI said, “At the time of applying modification for change in jurisdiction, an automatic online application for transfer to be sent to existing authority, which needs to be scrutinised within 15 days of receiving the application. No comments on the transfer application by existing authority within 15 days would result in auto-approval. Then the application shall move to destined licensing/registering authority who shall scrutinise the same. Once approved, the licence with its record/history shall shift to destined licensing authority. If rejected, the licence shall continue with the existing licensing authority (with no refund of licence fee)”.
Sagar Kurade, MD, Suman Projects Consultants, says that this was a good move by the food regulator as it would help the companies which were growing and expanding. And this move will also help the start-up businesses.
“India is witnessing a growth in the start-up ecosystem, so as the company grows, it requires better office space, more processing units or bigger units. This is equally true for the existing companies as well. So this decision will help in ease of doing business and reduce the regulatory hurdle,” he said.
Previously, the FSSAI has also allowed food businesses to migrate from State Licence to Central Licence or vice versa without change in the FSSAI licence number.
