FSSAI issues show-cause notices to Zydus Wellness, HUL

Ashwani Maindola, New Delhi
The Food Safety and Standards Authority of India (FSSAI) has issued show-cause notices to FMCG majors Zydus Wellness Products Limited and Hindustan Unilever Limited (HUL) over alleged non-compliant health claims on their popular nutritional drink brands, Complan and Horlicks.

For Zydus Wellness (Complan), the regulator questioned prominent growth and health claims displayed across packaging and online listings, including "GROW TALLER, FASTER," "CLINICALLY PROVEN 2X GROWTH," and "Growth Comes in 4 Flavors".

Additionally, claims such as "Supports Concentration and Memory" and "Pro Immunity+ 34 Vital Nutrients” accompanied by images of children were cited as violations of the Food Safety and Standards (Advertising and Claims) Regulations, 2018.

For HUL (Horlicks Women’s Plus), notices were issued regarding Horlicks Women’s Plus Chocolate Nutrition Drink (400 g) for statements such as "Nutrition for Strong Bones," "Clinically Proven to Help Improve Bone Strength in 6 Months," and "Healthy Muscles".

FSSAI stated these claims were misleading and contravened provisions governing the use of the term "healthy" in food claims. Further, the regulator noted that the "No Added Sugar" label was misleading due to the presence of maltodextrin, while the claim of "100% RDA of Calcium, Vitamin D & K2" failed safety requirements.

Regarding HUL (Horlicks Mother’s Plus), FSSAI flagged Horlicks Mother's Plus Kesar (400 g BIB) for claims like "Healthy Birth Weight" and "For baby's healthy birth weight". E-commerce title listings incorporating extensive health claims directly into product names were also cited for non-compliance.

Both food business operators have been directed to show cause within the stipulated timeframe as to why legal action under the Food Safety and Standards Act, 2006 should not be initiated against them.
