Thomas clarifies Centre's stand on allowing export of non-basmati rice

K V Thomas, minister of state for consumer affairs, food & public distribution, informed in a written reply in the Rajya Sabha that as per the current export policy, export of non-basmati rice, wheat, pulses and edible oils are prohibited.
However, exemptions are given from time-to-time for export of these items with the approval of the Empowered Group of Ministers (EGoM) / Cabinet Committee on Prices (CCP).
He further informed that in the July meeting of the EGOM, a decision was taken to allow export of 10 lakh MT of non-basmati rice from the privately held stocks and accordingly a notification was issued by the Director General of Foreign Trade (DGFT) to allow these exports. However, the same could not take place because of some exporters filing a petition in the Delhi High Court against the notification. The Court issued a stay order on these exports. "So it is not correct that the ban on export was lifted and re-imposed in July 2011, "said Thomas.
One condition for allowing the export was prior registration of the contract with the DGFT, which was done on a first-come-first-served basis subject to the following riders:
(i) Export shall be made from the privately held stocks.
(ii) Applications for allotment must be accompanied with irrevocable and confirmed letter of credit.
(iii) An applicant must submit a performance bank guarantee (BG), along with the application for a value equivalent to a value of 10% of applied quantity. In the case of non-completion of exports within the stipulated time frame, this bank guarantee is liable to be confiscated. A flexibility of + or - 5% in performance is allowed.
(iv) An application can be made for a maximum of 12,500 MT.
(v) This export will be subject to an MEP (minimum export price) of $400 per MT.
The minister further informed that through the above system allocation was made to 82 applicants on July 27, 2011.
But on the same day after the allocation was made, an order dated July 26, 2011, from the Delhi High Court was received, in which the Court had issued a stay order on the allocation of rice. Since the allocation was already made through Trade Notice No. 14 dated July 29, 2011, the implementation and operation of Trade Notice No.13 was stayed till further orders.
"Since the matter is sub-judice, the grant of registration certificate/permission will depend upon the final outcome of the court cases," Thomas informed.
