After receiving several complaints about food businesses using terms like ‘100%’ on food products’ labels and in advertisements, which consumers find ambiguous & misleading, the FSSAI has issued an advisory for discontinuation of the term ‘100%’ on food product labels and related promotional materials.
“All the FBOs are advised to discontinue the usage of the term ‘100%’ on food products label, packaging and promotional content,” reads the advisory.
The food regulator observed that terms like ‘100%’, in isolation or conjunction with any other description, is likely to convey a false sense of absolute purity or superiority, potentially leading consumers to believe that competing products in the market do not comply with prescribed standards.
According to the FSSAI, claims and terms like ‘100%’ are not defined under the FSS Act. Such claims, governed under the FSS Advertising and Claims Regulations, were not specified or even referenced in any manner under the rules made under FSS Act.
The FSSAI also cited norms under the FSS Advertising and Claims Regulations 2018, which strictly prohibit any advertisement or claim that undermines other manufacturers or influences consumers perception in a misleading manner.
The advisory added that under these regulations, food businesses were also required to maintain truthfulness, unambiguous, meaningful, non- misleading terms in their claims to help consumers to comprehend the information provided.
Although, the food regulator has not given any warning for the food businesses in case of violations of the norms, but ‘advised’ food businesses to discontinue the usage of terms ‘100%’ on food products labels, packaging and promotional content.
